Supreme Court to Hear Oral Argument in LA Port Case

On April 16, 2013, the Supreme Court will hear oral argument in ATA’s challenge to the Port of Los Angeles’ attempt to impose conditions on drayage carriers that are preempted by the Federal Aviation Administration Authorization Act’s prohibition on state and local laws related to the prices, routes, or services of any motor carrier. ATA will share its oral argument time with the Solicitor General’s office on behalf of the federal government, which agrees with ATA that the provisions in question are preempted. A decision in the case is likely by the end of the Court’s term in June.
