INDUSTRY AND LAW ENFORCEMENT GROUPS PETITION FMCSA FOR SUPPLEMENTAL CLEARINGHOUSE RULE
On May 5, ATA along with other industry associations and a law enforcement group petitioned FMCSA to issue a Supplemental Notice to its Notice of Proposed Rulemaking (NPRM) on its proposed Commercial Driver’s License Drug and Alcohol Clearinghouse. The petition calls for FMCSA to propose that employers report all instances of actual knowledge of misuse, including direct observations of misuse and employee admissions of misuse (except as provided in Section 382.121), to the proposed clearinghouse. The current proposal does not require employers to submit direct observations of misuse or employee admissions of use violations to the clearinghouse. As such, the proposal calls for perpetuating the current previous employer inquiry requirement so that prospective employers have a means to learn of these violations.
