GAO ISSUES REPORT CRITICIZING PHMSA’S WETLINES RULE

On Sept. 11, 2013, GAO released its study of PHMSA’s wetlines regulation. GAO’s report agrees with ATA’s position that the wetlines regulation could not justify its costs. GAO suggests that PHMSA’s data is far too subjective to be useful in underpinning any wetlines rulemaking. However, GAO also suggests that PHMSA modify its Form 5800 reporting process to specifically track whether or not releases are caused by wetlines breaches. Given the results of the GAO report, PHMSA is unlikely to take further action until it is able to gather new data that supports a rulemaking. Contact Boyd Stephenson at bstephenson@trucking.org.
