ATA Opposes DOL's Proposed Worker Classification Survey
In response to a request for comments on the U.S. Department of Labor’s proposed Worker Classification Survey, ATA expressed concerns that the survey’s construct would lead to unreliable information on which to base policy decisions and thus was not necessary for the performance of agency functions. While unstated, it is believed the survey is to provide the basis for agency’s expected Right to Know rulemaking, which would require employers to disclose the status and the analysis for why that status was determined for all independent contractors and all FLSA exempt employees. In addition to leading and biased questions, the survey is expected to have researchers unqualified in the intricacies of employment and agency law make classification decisions based on responses to a telephone survey.
